Insolvency

Nobody ever foresees insolvency when they first start a
business or make a property purchase.

The reality is that life can change in the blink of an eye, leaving you with seemingly impossible financial challenges.

It’s reassuring that should you find yourself in this situation, you can trust Heydons Lawyers & Attorneys to help you navigate the problem, and come out the other side still standing strong.

Our corporate insolvency services:

  • Deeds of company arrangement – Making arrangements with creditors on how debts shall be repaid, or the process should your business enter into voluntary administration or liquidation.
  • Voluntary administration – If your business is in trouble with creditors we’ll help. This could be a major loss, or a few months of poor sales. We’ll work to pause your credit repayments so you can reduce your most pressing debts, cut unnecessary costs, and get your business back to health again.
  • Liquidation – If you’ve reached the point where your business cannot function any longer and generate a profit, we’ll assist you with liquidation. Then you can organise and pay off your debts by winding up your business and selling its assets.
  • Receiverships – If you’ve received bank financing and provided security in exchange, the bank might make certain requests should you be unable to meet agreed terms. We’ll help you negotiate this request, whether it be to revise your business plan, or provide increased security from your personal assets.
  • Enforcing securities – If you default on a security agreement (or are the grantor in such an agreement) you’ll require assistance in the process of seising collateral, disposing of it (by power of sale), retaining it by assuming ownership through title transfer, or redeeming or reinstating it.
  • Realisation of assets – Should your company be liquidated, it might require its assets to be converted into available funds for creditors. The process of collecting, storing, valuing and disposing of assets for the best price via an agent or auctioneer will require our assistance.

If you aren’t sure where to begin, or need advice on making individual arrangements with creditors start by contacting Heydons Lawyers & Attorneys Principal Brad Heydon for a confidential insolvency consultation today.
