Conflict Resolution

Work it out the easier, faster, less costly way

When a disagreement occurs many assume that the only option for resolution is taking the matter to court.
This can mean a costly and lengthy litigation process for both parties. While this approach is one that
many may advise, ​at Heydons Lawyers & Attorneys we take a different approach.

Litigation – a last resort


We believe that avoiding litigation should be the first priority in conflict resolution. While it can generate costly fees, it isn’t always in the best interest of our clients. For this reason, we endeavour to seek alternatives.

At Heydons we approach conflict resolution by first understanding your real objectives in resolving disputes, and by listening to your real concerns. 
We understand that often a matter involving one issue can sometimes be about something else entirely. It’s our job to use alternative methods of dispute resolution so you get best course of action possible.

Preserve relationships and agreements.
​Resolve quickly and affordably.

A collaborative approach is a good starting point. It involves a promise by both parties not to escalate matters to court proceedings, and that a resolution will occur after several informal meetings. Direct negotiation is another tool that can help two parties to reach a mutually agreed upon consensus, while receiving expert legal advice in an informal setting.

If the above options don’t have enough structure and guidance, an expert appraisal is a solution where an independent expert can be appointed to make the decision.

There is also the process
​of mediation

Mediation allows both parties to bring the issue before an impartial and accredited third party, who won’t interfere or attempt to sway the proceedings.

Arbitration

An arbitration can be considered as a final option before litigation, offering formal dispute resolution in a judicial style hearing outside of the courtroom.

Most clients prefer a quick, confidential and less stressful alternative to resolving a dispute or conflict than through litigation.
